A driver who is legally impaired by blood alcohol may be legally able to drive under a new Maryland law that allows a person to drive while under the influence.
Maryland Gov.
Larry Hogan (D) signed the law on Friday, and it will go into effect in January.
The new law does not apply to drivers who are licensed to operate commercial vehicles and not drivers who have a blood alcohol content of 0.08 percent or above.

The law does allow the person driving to pass a blood drive test and take a blood sample for analysis.
The person who is driving under the law is not required to take a test.
Marylanders drivers with a DUI are also allowed to take another breath test to determine if they are under the legal limit of 0,02 percent.
The law says the test is valid for 30 days after the person takes it.
Drivers who test higher than 0.02 percent are still prohibited from driving.
The driver can still be cited if they test over 0.05 percent.
Driving under the alcohol limit in Maryland is a felony.
Drives with an illegal blood-alcohol content (BAC) are subject to a fine and up to three years in prison.
A BAC of 0 or more can result in a driver being suspended or arrested for up to 60 days.
